What is an EU trademark?

 The EU trademark is often a very interesting alternative to the national trademark registration, especially because the major part of Danish export is to the other EU countries. The EU trademark is a so-called unitary system which means that one EU registration is prevailing in all the member states of the European Union. All administration concerning the EU trademark lies with the EU trademark office (OHIM) in Alicante, Spain.

Through just one registration you obtain protection in the entire territory of the European Union.

 

You only need to renew one registration. In case you have older rights in the member states these rights can be continued in your EU registration (seniority). It only takes use of the trademark in one EU country to fulfill the use requirement. Changes of the owner's name or of a transfer only has to be recorded one place. Finally it has the advantage that the EU trademark is automatically extended to the new member states of the European Union.
