How do you transfer a patent?

Patents are transferable and it happens frequently. Trades with patents also take place, but the most frequent procedure is licensing. The right of the inventor can also be transferred and it can be taken in enforcement proceedings and be part of a division of matrimonial property. In that connection the ideal rights are not protected in the same way as is the case with the copyright, but the name of the inventor always has to be stated in the application.

 

With regard to the employer - employee relationship it goes that if the invention is made during working hours then all rights to the employee's invention shall pass to the employer. In that connection the employee has a duty of disclosure and the employer has a duty of notification regarding the invention made and the wish to acquire the right hereto respectively. Finally, the employee has a right to remuneration in case the employer acquires the invention, unless the invention in question is an invention that the employee must be expected to produce as part of his profession.
