What is comparative advertising?
It is legal to make commercials that compare one product to other similar products on the market. The information given in such commercials of course have to be truthful and provable. The products compared shall be chosen in such a way that all relevant products are included. It is important to pay attention to the fact that a comparative commercial cannot contain a direct or indirect derogatory description of other companies and their products.
You cannot sell your own product by criticizing another. It is not a mitigating factor that the commercial is based on provable facts or if you cannot identify the product that is criticized. All disloyalty is contrary to the Marketing Act.
