What does a design right imply?

Just like a patent or trademark right a design right is an exclusive right. The exclusive right means that the person who has created the design can use his design and prevent any third party from using it commercially through marketing of a product under a design looking like his.

 

The Design Act provides a general protection. If you have protected a certain design element, e.g. the design of a knob or a handle or an ornament; no one else can create a design looking like it, regardless of which kind of product they want to use the design for.
